1. Who We Are
These Terms and Conditions ("Terms") govern your use of www.ludingtonhobbies.com (the "Site") and any purchase of products or services from Ludington Hobbies, LLC, in store or online.

In these Terms, "we," "us," and "our" mean Ludington Hobbies, LLC. "You" means the person using the Site or buying from us.
2. Acceptance of These Terms
By using the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.
3. Eligibility
You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order. Some products carry manufacturer age recommendations; those recommendations are guidance for safe use and are not a substitute for adult supervision.
4. Products, Descriptions, and Availability
We do our best to describe and picture our products accurately, but colors, packaging, and manufacturer specifications can change without notice. Product images are representative and may not show the exact item, revision, or included accessories.
All products are subject to availability. Inventory shown on the Site reflects our best current count, and an item may sell in store before an online order is filled. If we cannot fill an order, we will contact you and issue a full refund for the unavailable item.
We reserve the right to limit quantities, refuse or cancel any order, and discontinue any product at any time.
5. Pricing, Sales Tax, and Errors
All prices are in U.S. dollars and do not include sales tax or shipping unless stated otherwise. Michigan sales tax is applied to taxable orders at the rate required by law.
Prices are subject to change without notice. Despite our efforts, a product may occasionally be listed at an incorrect price or with incorrect information. If that happens, we may cancel or correct the order before it ships and will contact you first. We are not obligated to honor an obvious pricing error.
Manufacturer minimum advertised price (MAP) rules may affect the price we can display online. Where that applies, the price is shown in the cart.
6. Orders and Order Acceptance
Your order is an offer to buy. An order confirmation email acknowledges we received it — it is not acceptance. The contract is formed when we ship the item or make it available for pickup.
7. Payment
We accept cash, credit cards and Apple Pay. We do not accept personal checks. Payment is authorized at checkout and captured at the time of order. You confirm you are authorized to use the payment method you provide.
8. Shipping and Delivery
We ship within the United States only. Orders are typically processed within 3 business days; orders placed on days we are closed are processed the next business day. Shipping costs are calculated at checkout.
Delivery estimates are estimates, not guarantees. Once an order is handed to the carrier, transit time is outside our control. Risk of loss passes to you when the carrier takes possession of the package.
Certain items — including lithium polymer (LiPo) batteries, fuel, and some aerosols — are subject to carrier hazardous-materials rules and may ship only by UPS, or may be available for in-store pickup only.
9. In-Store Pickup
Orders placed for in-store pickup are held for 7 days at 210 South James Street, Suite 101, Ludington, MI. We will contact you when the order is ready. Please bring your order confirmation and a photo ID.
10. Returns, Exchanges, and Refunds
Returns are accepted within 7 days of purchase or delivery. Items must be unused, in original packaging, and complete, with proof of purchase.
The following are not returnable: items that have been run, powered, glued, painted, cut, bound, or otherwise used; opened electronics; LiPo and other batteries; fuel and paint; clearance and closeout items; special orders; and gift cards.
Return shipping is the customer's responsibility unless the return is the result of our error or a defective item. Refunds are issued to the original payment method within 7 business days of our receiving and inspecting the return. A restocking fee of 15% may apply.

11. Warranties
Products are covered by the manufacturer's warranty, where one is offered. Warranty terms, duration, and claim procedures are set by the manufacturer, not by us. We will help you open a claim with the manufacturer where we can.
We are an authorized dealer for the brands we carry. Buying from an authorized dealer is normally what keeps a manufacturer warranty valid.
Ludington Hobbies, LLC sells all products "as is" except for the manufacturer's warranty. To the fullest extent permitted by Michigan law, we disclaim all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
Warranties do not cover crash damage, water damage, wear items, improper battery charging or storage, over-voltage, modification, or use beyond the product's intended purpose.
12. Repairs and Service
We service RC vehicles whether or not you bought them from us. Repair work is subject to these additional terms:
- A signed repair contract is required for any item left in our possession.
- We will provide an estimate before performing work that exceeds $100. Additional work requires your approval.
- Diagnostic fees, if any, are disclosed at drop-off.
- Parts availability affects turnaround time; we do not guarantee a completion date.
- Items not picked up within 14 days of notification that the repair is complete may be subject to a storage fee, and after 30 days may be considered abandoned and disposed of under applicable Michigan law.
- Repair work is warranted for 3 days on our workmanship only. Parts carry their manufacturer's warranty.
13. Safe Use and Assumption of Risk
The products we sell are hobby-grade radio-controlled vehicles, aircraft, boats, and related components. They are not toys. They move at speed, carry high-current batteries, and can cause injury or property damage if misused.
You are responsible for:
- Reading and following the manufacturer's instructions and safety warnings.
- Charging, using, and storing lithium polymer (LiPo) and other batteries exactly as the manufacturer directs, with an appropriate charger, in a fire-safe location, and never unattended.
- Operating in a safe, legal location, with adult supervision for minors.
- Complying with all federal, state, and local law, including FAA rules for remote-controlled aircraft.
You assume all risk arising from the use of products purchased from us.
14. Use of the Site
You agree not to use the Site to break the law, interfere with its operation, scrape or harvest data, attempt to gain unauthorized access, or misrepresent who you are. If you create an account, you are responsible for keeping your password secure and for activity under your account.
15. Intellectual Property
The Site, its content, layout, text, graphics, and logos are the property of Ludington Hobbies, LLC or our licensors and are protected by U.S. copyright and trademark law. Manufacturer names, logos, and product images are the property of their respective owners and appear here to identify the products we sell.
You may not reproduce, republish, or use our content for commercial purposes without our written permission.
16. Limitation of Liability
To the fullest extent permitted by law, Ludington Hobbies, LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of your use of the Site or any product purchased from us.
Our total liability for any claim relating to a product or order will not exceed the amount you paid for that product or order.
Some states do not allow certain limitations, so parts of this section may not apply to you.
17. Indemnification
You agree to indemnify and hold harmless Ludington Hobbies, LLC, its members, and its employees from any claim or demand, including reasonable attorneys' fees, arising out of your misuse of a product, your violation of these Terms, or your violation of any law or the rights of a third party.
18. Privacy
Our handling of your personal information is described in our Privacy Policy, which forms part of these Terms.
19. Text Message (SMS) Receipts
When you give us your mobile number at checkout and ask for a text receipt, Ludington Hobbies, LLC will send you transactional text messages about that purchase, such as a link to your receipt. We do not send marketing texts through this program.
- Frequency: Message frequency varies with your purchases. Typically you will get one message per purchase.
- Cost: Message and data rates may apply.
- Opt out: Reply STOP to any message to stop receiving texts. You will get one message confirming you have opted out, and no more after that.
- Help: Reply HELP, call (231) 239-7202, or email sales@ludingtonhobbies.com.
- Carriers: Carriers are not liable for delayed or undelivered messages.
- Privacy: Your mobile number and consent are handled as described in our Privacy Policy.
20. Governing Law and Venue
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Mason County, Michigan, and you consent to that jurisdiction.
21. Changes to These Terms
We may update these Terms at any time. The version posted on the Site at the time you place an order governs that order. Continued use of the Site after a change means you accept the updated Terms.
22. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the rest stays in effect. These Terms, together with our Privacy Policy and any order-specific terms, are the entire agreement between you and Ludington Hobbies, LLC.
